Nearly two years ago, we purchased a bare piece of ground near Keensberg, Colorado, with the intention of building on it. Shortly after purchase, we were made aware of numerous problems with the land, including a claim of ownership by another party, lack of legal access, survey inaccuracies, and no clear title to the property. All of this rendered the land unbuildable and worthless. We filed a claim with Chicago Title's claims side. They denied responsibiity for most of the problems (what is title insurance for, if not to provide protection for all of the above listed items?) and accepted some liability. Instead of simply paying us for the land that we could not use, they opted to engage in a nearly two year (and ongoing) fight with the third party, and are now in the process of suing the party who sold us the land. In the meanwhile, we are paying a huge payment on a piece of ground that cannot be used or sold, and is completely worthless. This situation has prevented us from retiring, and has caused incredible stress. Chicago Title has been utterly unmoved by repeated pleas to settle with us for the cost of the land and our expenses to date. They are aware that we do not have the resouces to litigate them, and instead, seem to be dragging this out until we just relent and give them the land (in their representative's words \the company is open to a settlement offer\) This is so unjust and unfair. The purpose of this review is to urge consumers not to use Chigago Title when selecting a title company. When problems arise with title issues on a land or home purchase, you want a company who will stand behind you and make you whole rather than trying to drive you into bankruptcy. As a consumer, you can pick the title company that you want. I think that anyone would be taking a big risk using Chicago Title.

Our house is not marketable due to errors during the Title investigation. They clearly had a survey in hand and missed all the measurements that do not match the recorded plat with the city. They were able to determine our property encroached the easement on one side, but missed that our house is encroaching ten feet on the property on the other. The examiner was definitely sleeping at the wheel. We filed a claim with Chicago Title and they wanted nothing to do with the situation. They also couldn't tell us why we paid for an extra risk policy. They apparently knew something was wrong. We were hoping that they would own up to their mistake and take care of the issue. Do yourself a favor and choose a company that will actually cover you.
